Owner's vs lender's title insurance

Title insurance protects against problems with ownership that happened before you bought the property, such as an old lien, a forged signature or a missing heir who later makes a claim. You pay for it once, at closing.

Lender's policy

If you are getting a mortgage, most lenders require a lender's title policy. It protects the lender for the amount of the loan. It does not protect your equity.

Owner's policy

An owner's title policy is optional, but it is the one that protects you. If someone sues and says they have a claim against the home from before you bought it, the owner's policy covers your legal defense and covered losses. The Consumer Financial Protection Bureau notes that buying both policies from the same company usually costs less than buying them separately.

In most cases you can shop for title services instead of taking the first name on a list. Ask two or three title companies for a quote on the same title insurance and closing services, and compare them line by line.

What a title search can turn up

Before a policy is issued, the title company searches public records for the property. A title search or lien search can find:

  • Unpaid mortgages or home equity loans that were never released after a payoff.
  • Liens from contractors, the IRS, the state or a court judgment against a past owner.
  • Unpaid property taxes or special assessments that must be settled before closing.
  • Easements and restrictions that limit how the property can be used.
  • Errors in recorded documents, such as a wrong legal description or a misspelled name.
  • Ownership gaps, common in estate and family transfers, which may need a probate attorney or quiet title attorney.

How a title order moves to closing

    Order received

    You open a title order with the property address, the parties and your contact details. You get an order number and a private status link.

    Title search

    The title company searches public records for liens, taxes, recorded documents and ownership history.

  3. 3

    Commitment issued

    The title commitment lists what must be paid off, signed or fixed before a policy can be issued. Your agent, lender or real estate attorney reviews it.

  4. 4

    Clear to close

    Conditions are cleared. If you have a mortgage, federal rules say you must receive your Closing Disclosure at least three business days before closing.

  5. 5

    Closing and recording

    Documents are signed, funds move through escrow, and the deed and mortgage are sent to the county Register of Deeds for recording.

    After closing

    The buyer files a Property Transfer Affidavit with the city or township assessor within 45 days of the transfer, and the title policy is issued.

Check a title agent before you close

Title insurance in Michigan is regulated by the Department of Insurance and Financial Services (DIFS). Title insurance agents and agencies are licensed, and you can look up a license with the free DIFS license locator. DIFS also answers licensing questions by phone at 877-999-6442.

Deeds and mortgages are public records kept by each county's Register of Deeds, which is where the title search starts. Title companies on Rebuild Detroit are independent businesses; confirm the license and ask for a written quote before you commit.
